Abstract:
There can be little doubt that the power of the driver's license as a driving under the influence (DUI) countermeasure resides in the state's authority to withdraw the license. This process involves three components of deterrence: special, general and incapacitation. This paper explores what is presently known about controlling the persistent DUI offender through driver licensing. This entails a description of currently used DUI countermeasures--both their strengths and weaknesses. Weaknesses are summarized along with proposals that have been previously advanced for increasing the effectiveness of driver licensing in controlling the hard core DUI offender.
