Title: Liabilities of Public Agencies for Intelligent Transportation System Projects

Availability: Transportation Research Board Business Office 500 Fifth Street, NW Abstract: Ever increasing congestion on American highways is leading to the increasing deployment of technology for traffic management purposes. Because many of the deployed technologies are relatively new, there are increased liability risks to the public agencies that operate them. Moreover, knowledge on the history of liability regarding deployed transportation management technologies is scarce. This research identifies the liability of transportation management technologies through a literature review and a survey of state transportation agencies. Successful risk management practices used in intelligent transportation systems can benefit many state transportation agencies. The results show minimal liability concerns regarding automated toll collection and more significant concerns over reversible lanes. The survey also discovered that state agencies using variable message signs and work zone warning technologies that failed, were subject to lawsuits. Lastly, most agencies believed that future changes in ITS risk management practices were inevitable and the Manual on Uniform Traffic Control Devices offered a great forum for this guidance.
