Abstract:

For the fifth time since its initial publication in 1976, "Selected Studies in Highway Law" (SSHL) is being augmented, this time by 8 new papers, 12 supplements to papers already published in SSHL, and an additional chapter. Also included in Addendum 5 are four sets of replacement pages for the Title Page and the Contents of Volumes 1, 2, 3, and 4; four sets of new Preface to Addendum 5, Transportation Research Board institutional description, and Project Committee listing for Volumes 1, 2, 3, and 4; and a revised Subject Index. The 8 new papers to be included in Volumes 3 and 4 are as follows: Suspension, Debarment and Disqualification of Highway Construction Contractors, D.W. Harp; Liability of Public Agencies Arising Out of Rejection of Bids and Misaward of Contracts, R.W. Bower; Civil RICO Applications in the Highway Construction Industry, K.F. Brickey; The Application of NEPA to Federal Highway Projects, D.R. Mandelker and G. Feder; The Public Duty Defense to Tort Liability, K.G. Nellis; Impact of the Discretionary Function Exception on Tort Liability of State Highway Departments, J.C. Vance; Impact of 42 U.S.C., Section 1983 on Highway Departments, Personnel, and Officials, D.H. Merriam and C.L. Propst; and Public and Private Partnerships for Financing Highway Improvements, J.W. Wegner. The new chapter, Chapter X, Motor Carrier Law, contains the following paper: Trial Strategy and Techniques in Enforcing Laws Relating to Truck Weights and Sizes, W.C. Arnold.
