Title: A REVIEW OF EMERGING ALTERNATIVES TO RESOLVING DISPUTES OTHER THAN BY LITIGATION - WHERE DOES THE "PRACTICE OF LAW" BEGIN? PAPER PRESENTED AT THE 27TH ANNUAL WORKSHOP ON TRANSPORTATION LAW, STAMFORD, CONNECTICUT, JULY 24-28, 1988

While certain forms of ADR, such as arbitration, have been around for decades, the new emphasis on ADR in the eighties is a child of necessity brought about by the crushing case load in both state and federal court systems. This paper presents a review of emerging ADR procedures now in common usage. It concludes with comments on the protection of confidentiality of statements made during ADR.
