Abstract:

The Airline Deregulation Act of 1978 provides that the Civil Aeronautics Board (CAB) will sunset on December 31, 1984. The Act also provides that certain international aviation functions of the CAB will transfer to the U.S. Department of Transportation (DOT) on that date. Among the transferring functions will be authority to select carriers to serve limited-entry international markets, to enforce fair competitive practices in international markets, and to review tariffs for foreign air transportation. Certain other international functions, including review of mergers and inter-carrier agreements and granting of antitrust immunity are scheduled to be transferred to the Justice Department. However, under a variety of pending proposals, these functions would also be transferred to the DOT. Before assuming these responsibilities, the U.S. Department of Transportation decided to provide for a full and open discussion of how the functions are currently administered by the CAB and whether the procedures used by the CAB can be improved. To that end, public comments were requested in Docket 76, Recommendations for DOT Procedures to Perform International Aviation Functions, "Federal Register", Vol. 47, No. 232, December 2, 1982. In addition, a seminar open to interested parties was held at the National Academy of Sciences in Washington, D.C., on March 2-3, 1983. This volume, Volume I, contains a summary of the proceedings of that seminar, which was attended by over 200 interested individuals. Appendices contain the seminar's program, panelists, and attendees. Volume II (separately bound) contains the full text of the papers presented at the seminar.
