Abstract:

Well-established, though continually developing civil law pertaining to noncontractual liability is explored in an effort to find alternatives to social regulation of the relation between risk makers and risk takers. Civil liability as compensation for private industry is discussed with attention to fault-based (tort) liability and alternative systems of liability. Civil liability is also discussed as an instrument of social (safety) policy. This discussion considers legislative intervention, liability resulting from noncompliance with regulation, and compliance as a defense to liability. Observations are made and the conclusions drawn are presented.
