Availability: Find a library where document is available Abstract: Three issues related to impact fees are addressed: (1) the evolution of impact fees; (2) legal considerations in financing off-site public facilities, including roads; and (3) some of the complexities involved in the creation of an impact fee system at the local level, with specific reference to work in Raleigh in designing a road impact fee ordinance. The article discusses the new generation of land use regulations (with reference to the town of Ramapo, New York), and traces the movement toward private financing of infrastructure. The legality of impact fees is also discussed. The 5 requirements that a valid road impact fee ordinance must satisfy are listed and discussed.
