Title: Payments to Public Utilities for Relocation of Facilities in Highway Rights-of-Way

Abstract: The subject of relocation of public utilities located in highway rights-of-way has been an important topic for many years. This paper is concerned, first, with the extent to which either the State or the utility must pay the cost of relocation when the utility is required to move its facilities because of highway construction or improvements. Discussed second is the reimbursement of States for payments to utilities pursuant to Title 23, Section 123 of the U.S. Code.
