Abstract:

CONTROL OF ROADSIDE LAND USE IN OKLAHOMA IS DISCUSSED. OKLAHOMA DOES NOT HAVE ANY CONTROL. HOWEVER, ONE CITED CASE DOES SAY SOMETHING ABOUT CONTROL OF ACCESS THAT IS CONCERNED WITH THE USE OF ROADSIDE LAND. AT THIS TIME THERE HAS NEVER BEEN A CONDEMNATION ACTION IN OKLAHOMA INVOLVING AN INTERCHANGE. THIS MAY BE BECAUSE LAND IS ACQUIRED FOR INTERCHANGES FAR IN ADVANCE OF THE TIME LAND IS ACQUIRED FOR THE ROADWAY. MANY ENCROACHMENT ACTIONS HAVE BEEN BROUGHT IN OKLAHOMA. NOW WHEN THE OKLAHOMA STATE HIGHWAY COMMISSION GOES INTO A TOWN TO BUILD A HIGHWAY, AN UNDERWRITING AGREEMENT IS MADE WITH THE TOWN PROVIDING THAT THEY WILL REMOVE AND KEEP THE HIGHWAY FREE OF ALL ENCROACHMENTS FROM THAT TIME ON. IF THE BUREAU OF PUBLIC ROADS DOES NOT APPROVE THE JOB BECAUSE THERE ARE ENCROACHMENTS ON IT, THE TOWN NEVER GETS ANOTHER JOB WITHIN ITS LIMITS. AT THIS TIME, THERE HAS BEEN NO ANSWER TO THE BILLBOARD PROBLEM IN OKLAHOMA.
