The American Recovery and Reinvestment Act (ARRA) has its own provision. Other components of the Department of Transportation (DOT), such as the Federal Transit Administration (FTA), have their own statutory Buy America requirements, which may be similar to, but not identical to, the requirements governing AIP. The FTA in particular has issued extensive guidance and regulations governing the subject. The Buy America requirements, mandated by federal law, have created confusion among federal grantees, consultants, contractors, and the airport industry in general. The FAA issued guidance on Buy America requirements for the AIP and ARRA in the form of Program Guidance Letter (PGL) 10-2 (February 24, 2010). The focus of this guidance, however, is on the application of the waiver and exception provisions in the statute. Confusion about other aspects of the requirements may linger. Confusion and uncertainty in the way federal requirements apply can be costly or considerably delay the purchase of essential equipment. Buy America provisions have been in existence since the 1933 Buy American Act (BAA), applicable to the procurement of goods by federal government agencies. This digest discusses the legislative history pertaining to Buy America, the applicable federal regulations, and how it has been applied at airports. The author provides guidance that airport counsel will find useful as it pertains to airport construction and equipment purchases to ensure compliance with FAA regulations.
